Questions Regarding ILR Dependant of Brtish Citizen (Previously T1 General)

Hi All,

Hope someone could help.

I have recently got my British Citizenship through (ILR + Tier 1 General 5 Year route)

I am planning to apply for ILR for my dependents (Tier 1 General Dependants),
Background: My partner is in the UK since June 2013 and my daughter since Aug 2014.



I have a few questions, would be really grateful if you could help:

1) Do I apply for Set (M) or Set (O) for my dependents ILR application as they are on T1 General Dependant category but I am now British citizen?

2) My wife has been in the UK for 5 years 9 months (June 2013 till Mar 2019) and the longest my wife is away from the UK is 9 months (Nov 2013 to July 2014) during pregnancy, would that affect her ILR ? do we count 5 year route for T1 Dependents from the time they enter the UK or the continues 5 years without long gaps?

3) Should I apply for ILR for my daughter along with my wife's ILR application?

4) To prove continues relationship, we have to send proof of 2.5 years (i.e 30 months statement) utility bills to prove we are living together?

5) To meet English language requirement, my partner is going for Trinity College: - Graded Examination in Spoken English (GESE) Grade 5 (CEFR Level B1.1) hope this one is ok?

SET(O). The fact that your are British is irrelevant

Visa issue date. PBS dependants do not have absence limit unless visa was issued after 11 Jan 2018
3) Should I apply for ILR for my daughter along with my wife's ILR application?
Yes. When both parents are settled the child can get ILR
4) To prove continues relationship, we have to send proof of 2.5 years (i.e 30 months statement) utility bills to prove we are living together?
2 years cohabitation proof
5) To meet English language requirement, my partner is going for Trinity College: - Graded Examination in Spoken English (GESE) Grade 5 (CEFR Level B1.1) hope this one is ok?
Yes that is acceptable

Many thanks for your quick reply.

I was hoping if you could please advice below:

1) There is one section on the SET(O) online form which asks
"Have you previously lived in a country outside the UK including your country of birth?"

I am not sure if its asking details for the last 5 years or from the life span of the dependent, i.e for the last 32 years?

2) Do I have to send 2 years worth document (24-month statement from 2 sources (council and water bill) in the joint name) or does it need to be 4 documents for 2 years ( i.e 1 water bill and 1 council bill for 2017 and 1 water bill and 1 council bill 2018)?
