ILR - partner of a settled person?

Hi all

I obtained my ILR in Sep 2018 (via Tier-2 5-year route), and now my wife is going to apply for ILR as she is now eligible as she has been on PBS Dependant visa for the last 5 years. She has checked her eligibility on the UKVI website which shows that she is eligible and how she can apply. However, there is a statement on the website which is a little confusing:

Eligibility for partners
Your current visa must be as a dependant on your partner’s tier 1, 2 or 5 visa.
If you got your current visa as your partner’s dependant after they settled in the UK, you must apply as the partner of a settled person instead.


My wife made an application for renewing her PBS Dependant visa in September just one day after my ILR was approve at a Premium Services Centre, so her current visa (PBS Dependant for three years) has been renewed (obviously) after I obtained my ILR. Therefore, does she need to apply as the partner of a settled person instead? In this case the required documents would be different from the normal Tier-2 Dependant ILR application. Any advice would be greatly appreciated.

No. If she meets the 5 years residence requirement as a PBS Dependent, she applies on form SET(O) via PBS dependent route.
