Tier 2 dependent to ILR

Hi,

Me and my wife got our first tier 2 dependant on 19-June-2013. I got my ILR approved in June 2018. However, my wife went back to India for maternity on 11/12/2014 for 308 days. Her Current visa is expiring in May 2019. Under Jan 2018 - 180-day rule, Is she eligible ILR?

2nd question: I hold ILR status and if my wife is eligible for ILR, can my 3 year old son apply for ILR? . He got his first tier 2 dependent visa on sept-2015.

The January 2018 absence rules ONLY apply to visas issued AFTER the 11th January 2018. Her absence is irrelevant. She could have applied for ILR last year already when you applied.

Child can apply for ILR with your spouse.

Just to double check, my Child is only in Tier 2 dependant for 3 years and 7 months. Is it still ok to apply for ILR now?

I am asking the question again as its £3k in fees and lot of money to risk.

Thee is no minimum residence period for children!!
