Son born in the UK ILR OR British Passport

Hi,

My wife and I are applying for ILR (same day service) this month with I currently being on Tier 2 General and my wife being on PBS Dependant.

Our son was born in the UK in March 2017.

Do we need to applying him as ILR Dependant or for a British passport directly?

If we can apply for his British passport directly, then when is a the latest (how many days after) we should be applying once we get the ILR?

As he was born before you got ILR, he needs to be registered as a British citizen using Form MN1 first before he can apply for a British passport.

Any children born in the UK AFTER you get ILR will be British citizens by birth.

You don’t need to apply ILR for him, you will just register him as BC once your ILR is approved. It will save you money.
