Set(M) question - cohabitation period

Hi all,
Me, my wife and our son have entered the UK in early May 2014 on Tier 2 General visa basis. I have applied to super priority ILR (Set O) and successfully received it late April.

My wife and son are now separately applying as dependents using Set (M) route. One of the question is their form is:
6 letters and/or other documents addressed to you and your partner at the same address to show that you have been living together during the past 2.5 years
You must provide 6 letters or other documents addressed to you jointly or in both your names.
If you do not have enough items in your joint names, you may also provide items addressed to each of you individually, if they show the same address for both of you.

Providing both one letter sent individually to you and one letter sent individually to your partner at the same address is the equivalent of one letter addressed to you jointly.

For example, you can provide 4 items of correspondence in joint names to the same address, 2 items addressed to you at the address, and 2 items addressed to your partner at the address, for a total of 8 items.

If you and your partner have no bills or correspondence in joint names, you will need to submit 12 items (6 each) of correspondence showing that you live at the same address.
I am surprised to see 2.5 years requirement here. I have heard from other people who applied whole family at the same time, that they had to prove 5 years of cohabitant (not 2.5).

Can please someone clarify if I need to prove cohabitance over 2.5 years or 5? Why is this different between applying all together or separate? Thank you

Set m is the WRONG form. If they hold pbs dependent visas they MUST apply on form Set O.

Using set m will result in a refusal and loss of fee paid.

Thank you very much. It makes sense now

So we have filled out Set (O) for my wife and son now. But, surprisingly there is no cohabitation requirement whatsoever. So I have questions very similar to original:

1. Why separate submission of dependants via SET(O) does not require cohabitation evidence? (I heard that when you submit together - 5 years of cohabitation evidence is required).

2. Shall I still submit something to be safe? Is there any best practice for such cases?

Thanks a lot in advance

Follow the guidance. Do not just rely on the checklist.

Thanks tier11417. Would you please refer me to the specific guidance I shall look at?
(That said, it is strange Home Office system does not showing right list of documents)
