Hi,

I have a query regarding the ILR application SET(O) Form for Tier 2 (General) dependants. I am filling in the online forms for myself, my wife and three children. We all were granted 5 Years Tier 2 (General) visa on 22nd June 2014 and qualify for ILR on 25th May 2019, however I will be submitting the online application on 28th May due to weekend and bank holiday.

My query is for the dependant’s online form, there is a question as below:

Does the period of stay on which this application was based include any leave granted since 11 January 2018?

I am not exactly sure whether to say “Yes” or “No” as I think I do not understand this question properly.

All dependants were outside the UK as per below schedule, none was more than 180 days on any 12 months period:

Family first entered the UK – 24th July 2014
Family exit to Pakistan 4th December 2015 – Entered UK 16th January 2016 - 43 Days
Family exit to Pakistan 7th December 2016 – Entered UK 8th January 2017 - 32 Days
Family exit to Pakistan 20th July 2018 – Entered UK 2nd September 2018 - 44 Days
---------------
Total Days outside UK - 119 Days
---------------

I will appreciate if anyone can advise for the above.

Thank you,

Kind regards,
AEjaz

It is NO as her visa was granted before 11th January 2018 and she is not subject to the absence limits.
