Hi, Could you help me clarifying my below concerns on my ILR? I am trying through the 10 years long residence route as I first came to UK on October 2010 through Tier 2 ICT. I have below gaps and would that be considered as allowed absence?

I have done 3 renewals until now and all were done in UK. CoS is provided by the same employer since I came to UK and no break in my VISA

1. A gap of 215 days in 2013, I went to my home country for a project transition through my employer. My payroll was not running during my absence in UK.
2. A gap of 208 days in 2014, I went to my home country for a project transition through my employer. My payroll was not running during my absence in UK.
3. A gap of 100 days from 2016 till 2018, I travelled to Germany for project transition. My Payroll was running during my absence in UK.

What other evidences can I show if the above mentioned absences are not considered? Thanks in advance!

If you have an absence of 180 days or more in one go, your long residence is broken and you won't qualify for 10 year long residence ILR.

All absences count. There is no difference or distinction made between personal or work related absence.

Thanks for your quick response! If I produce a letter from employer stating that the travel was due to customer requirement, will that be of any support?

I have seen few cases with my friends who have successfully got the ILR with a gap of one year, is there any document available to say what are the allowed absences?

No. You have two lo g absences and they have broken your residence

Possibly if they applied for ILR visa pbs route which has completely different rules to ILR based on long residence, which is stricter.

Long residence has a max absence limit of 540 days in the whole 10 years and any single absence of 180 days or more breaks your residence. HO don't have discretion on this, the rules are very clear.
