ILR salary Requirement

Dear all gurus.

Please do request you to help and advice for the below questions.

I had 5 years of Visa (Tier 2 General) from July 2014 to June 2019 but in December 2018 our company’s sponsorship license got expired so I had to reapply our visa as an extension which we (me and my wife) have received it till July 2020. But I am planning to apply my ILR in July 2019 as my 5 year terms get completed.

My SOC Code is 2122 as mechanical Engineer
Salary rates:
New entrant: £28,900
Experienced worker: £33,000
My job does not come in oil and gas I have applied as general.

My salary was 28k while taking New COS under new sponsorship license. For extension as an experience worker I had to maintain 33k salary. so during my COS application I had used my company’s car allowance tax from my P11D which makes the total of 33147 and received the COS and hence the Visa. (Submitted P11 D for last 5 years just to make sure that I have been using car and paying tax on that regularly)

Now my basic salary has increased to 33k from April 2019 (notified via Sponsorship management system no body has contacted till date) but it is lower than 35800 as ILR requirement for tier 2.

My question is can I still use the car allowance for ILR or should I wait till next year for one more raise than apply as I have got 1 year extension.

Our company working hours are 35 per week will that make any difference in calculating per month salary.

Please give your suggestions.

You should add acceptable allowances to your gross salary to work out the points you will
be awarded. If you have exchanged some of your UK employment rights for shares as an
employee-owner, however, we will not count the value of those shares as part of your
salary package.

Dear Zimba,

Thanks for your reply,

I just want to clarify i have been using Car and having all 5 years P11 D. would that be acceptable as i have already used at the time of COS. I can get a letter from my Company stating that i will be having company car guaranteed till i work.

I do have a letter From HMRC stating my car tax allowance + my income as 33147 which will increase to 38147 now.can I use that as a proof of my total income before tax.

Please suggest.

Please read the guide. It explains what allowances are included. Your employer better confirm the benefits in a letter
