Tier 2 to ILR

Hi All,

I tried going through the forum but have mixed opinions for the following,.So wanted to clarify.
I am applying from Tier2(5years)-> ILR.

1) First Entry inside UK: I entered as Student. Should I mention that or the date I got my Tier2.

2)Do I need to mention my paternity leave(1 Week) Which was taken 1.5 Years ago-> The question is just "Are you on Paternity/Maternity Leave" Does this Leave mean We have taken fund from Government?

3)I have got 3 PCN related to Car(Crossbox, No right turn, parked in a suspended bay )one in June2017, Jan 2018, Nov2018. Everything is paid and closed.
Need to know under which conviction should I mention it in the application if not Can I write in the cover letter.

4) Do I need to mention the stamped date or the date of my Travel based on flight ticket.
Example: In Heathrow there is no stamp but there is a stamp when we reached FRANCE.
Return we have stamps from France and Heathrow? Which one should I consider.

5) "Absence OutsideUK'' I need to fill only 5 year history eventhough my First enter date as Student was 8 Years ago?

Hi,

I can answer question 4&5 based on my application experience.
I applied at Sheffield under premium category and received an answer the same day and this is what I did in my application.

In General, regarding your stay, they only care about the 5 years backdating from when you make your application with respect to the continuous period of stay but I mentioned all my leave of absence from the country since I entered 6 years before my application date.

If I were you, I would mention that I entered as a student in the cover letter providing all dates.

Answer the questions to the point in the application- If the question is when did you first enter, say when you actually did regardless of what visa you were on. if the question specifically asks for category then reply accordingly.

As long as the leave of absence during the 5 years is not more than the limit set (180 days? I guess it was that when I applied last September) in any 12 month period you should be fine. They just ask for proof sometimes if its more than 30 days continuous- I had a letter from my employer with a table listing all my absences and a statement saying all the absences are in line with company annual leave policies. In your case, if the paternity leave is in line with company/sponsor rules, you should be fine.

In any case, the Letter from the Employer is crucial- Make sure you got this.

Q4)
Ans: The UKVI has a record of when you enter and leave. if you provide a letter from the employer with the dates that should be fine. in the letter I submitted, I put the dates of my flight departure from UK and the date my flights arrived back- put this in a letter and get it signed from your employer.

Q5)
Ans: They only care about your last 5 years but I gave them the details of all absences since I moved to the UK (for the last 6 years) in the letter from my employer.


I THOUGHT My case was even more complicated because I moved jobs and my previous employer refused to provide me any letter but I clearly mentioned that in my cover letter...... They didn't even ask me about it at the centre :D

Thanks a lot for your reply.
4&5 Sorted: I will get a letter from employer based on Departure and arrival dates and same I will fill in my application even though there is no stamp in passport.(I will get letter for 5 years so will fill 5 years detail in the application). Do I need to upload my flight tickets in this case?

I will wait for others to reply on 1,2,3.

ILR was successful , I will just inform what I did so It might be helpful for someone.
1) DAte of Entry as student.
2)Paternity leave I entered the date from when to When.(SUBMITTED CHILD'S birth certificate)
3) PCN we wrote in Caution or any other penalty under convictions.
Mentioned the PCN number and also mentioned it was paid and closed.
4)Got the letter from employee on the absence(5 years only)
