ILR TIER 2 GENERAL QUALYING PERIOD

Hi All,

Just need advice on my ilr qualifying period.
My psw visa was expriring in dec 2013 i applied for tier 2 general visa in dec 2013 with same employer i was working on psw but for diffrent role on COS my tier visa got rejetced after application but later i won appeal in nov 2014 and then i was issued visa almost 15 month after in mar 2015 currently i am on tier 2 genewal visa which expires in sep 2021 .i need to know when do i qualify for tier2 5 year ilr from dec2013 or march 2015 when my first tier 2 visa was issued.I was working for same employer who gave me first sponsorship for tier 2 while my visa was under appeal but jobe role was different.

Please advice ilr qualifying period.

Your 5 years qualifying period starts from the date your tier 2 visa was granted, so March 2015.

Thanks CR001 for advice.
Even if I was working for same employer during my appeal period I cant account that in 5 five year tier to ilr process also re call one more thing I was allowed to start my new job in oct 2014 which I was sponsored for when I my employed wrote to home office to check if I can work.

But visa was granted in march 2015 but was granted only for 20months as per my cos end date dec 2016.


Please advice.

Your previous PSW visa conditions would have continue under section 3C of the immigration rules until the appeal processes was completed and Tier 2 visa issued. So no, you cannot count the time waiting as your PSW was the 'active' visa until the tier 2 was granted and PSW does not count towards 5 years ILR. The immigration rules clearly state you need 5 years on Tier 1 or Tier 2.
