Hi ,
Can anyone suggest me what can I do for my situation I explain :
10 yers route ILR APPLICATION REFUSE-

Right now I have tier-4 Depandent visa which will be expire 6/01/2020, I came UK 22/06/2009 as a tier 4 student visa was till 17/04/2013 . Before visa expire I applied on 23/08/2012 for a Residence card as the spouse of an EEA National but were refused on 11/10/2013. I lodged an appeal on 30/10/2013 which was dismissed as the first tier hearing on 17/03/2014 after appeal right exhausted on 27/03/2014.

They said to me you applied almost a year out of time on 09/04/2014 for LTR as a tier 4 general student and were granted LTR from 03/06/2014 to 31/12/2015.

My question is I was applied my EEA application on time before my visa expire but they did not count my time that period .

Please advice what can I do now....

When did you marry your EU citizen (non British)spouse and was it an islamic ceremony or at the registry office free ho approval?

What were the reasons for RC refusal?

No you did not. AN EEA based application does NOT engage section 3C under the immigration act as it is NOT under the UK immigration law regardless of the fact that you had Tier 4 visa when you applied. There is no such a thing as in-time EEA application when you hold a UK visa. This means you had no valid leave between 17/04/2013 (last day of your Tier 4 visa) and 03/06/2014 when you were granted visa again under UK rules :!:
The refusal is correct
