Applying for ILR on Spouse visa switch?

If someone has been living here for 9 years lawfully as a tier 2 dependent. if they leave and get a spouse visa within 3 months ( keeping in lines with any unbroken life rules). Are they able to apply for ILR as a 10 year applicant after 1 year on the spouse visa, despite the change in visa and the small gap in stay in the UK? as long as the gap doesn't break the max for days stayed outside UK? I have read that as long as your conform to the continuous residence rules your ILR clock doesn't reset.
