10 years long residency

MY immigration HISTORY

- applicant granted EC as a student from valid from 09/09/2009 until 30/11/2012
- granted extension as a student valid until 24/07/2014
- on 24/07/2014 applied as a student. was refused with ROA, appeal concluded 07/01/2016
-spouse visa application was raised on 08/01/2016, therefore app is within 28 days of appeal concluding
- CASE CONSIDERED UNDER FIVE YEAR ROUTE ( R-LTRP1.1 A,B.C) VAILD UNTIL JAN 2019.
- Granted extension as a spouse valid until SEP 2021.

Could someone please advise me if i hold 3C leave????
Am i eligible to apply for 10 years long residency ILR route???

Yes. You are eligible to apply within 28 days of completing your 10 years counting from your first date of entry to the UK in 2009

Thank you for replying.
Because ROA concluded and I applied for Spouse visa within 28 days time frame thus my 3C leave continued?
Am I correct?

No. You had no section 3C however your overstaying period between the leaves will be disregarded as you applied within 28 days under paragraph 39E of the rules
