Dear Zimba & Marcnath

Please help me to release this big tension. I never visited immigration boards before but since many weeks I am visiting regularly and its really one of the best site to get updated information and guidance and you all peoples are really very co operative.

I applied for Tier 1 Entrepreneur Ilr in June 2019, just prepared all documents after reading the guidance carefully. In ilr part of guidance I did not find any thing related to send business activity and employees roles etc while I am looking that every one is saying that its compulsary and the reference of Page 26/27 from the march 2019 guidance given. Could you please clarify this that this is most important to send these details with ilr documents becuase I did not send anything like this. All other documents those are shared in ilr forum were the same but I am more curious about this now.

Could you moderators please advise and if its most important then how much information could be provided and what address to be sent over.

I just want to mention that I am running a business management consultancy firm very successfully and been interviewed in my extension for almost 4 hours and extension was granted after a week of inetrview.

Please guide and advise.

Yes.. it would be wise to send a description of Your role as the director and the employees job description. Applicable from 06/04/19 on ext and settlement(ILR) applications

Please clarify with some guidance references, as I am still not clear.
The post you referred me is that the proposed changes from 6th April and its mention in guidance as well.
Let me simply explain
There are 3 parts of the latest guidance as before:
1. Initial Applications
2. Extension Applications
3. ILR Application
Every type of Tier 1 Entrepreneur application has its own requirements and more OR less extension and ILR requirements are almost the same except accounts etc but on page 26 and 27 of guidance for extension applications it is clearly mentioned about the roles and responsibilities and not anywhere in ILR part
MY question is related to ILR application and does this said in rules anywhere that your ILR application will be refused if you did not provide the above-mentioned details.
Also, I already sent employees contracts that clearly mention their job roles but I did not mention anything about me anywhere in covering letter while I am also working for my business.
If this document is mandatory then please guide so 100's of applicants will be benefitted and also let me know where and how to send these documents, please.

I'm in the same boat as I am also confused with this requirements as I think no one is sure whether this need to be sent or not as it's mentioned in extension section.

Aman has already responded. We can only advise you to send the necessary documents. Anyone applying after 29th March 2019 has to submit these. You risk delays/refusal if not. However, its totally up to you if you dont want to send. Let us know how it goes. Why not be the first one NOT to submit and update your thread?

I believe you probably took things in a wrong way.

I was just asking the reference from the guidance or from immigration rules.

No one wants to ruin his future as you are saying that don't send if I don't want, I am just asking to advise with reference. I believe lots of peoples are searching for this.

I read somewhere that sending extra documents causes delays as well. I also mentioned the reference from the guidance that where it was mentioned, also I did not say that I am not going to send documents if necessary but must have a piece of mind that I am following the rules.

I also asked to advise if this document is mandatory so let me know where to send and how?

Anyhow thank you but if you still have any valid argument on this so lots of peoples could be benefitted, advise then

This topic has been discussed/argued at length on this forum where some of us believe that it is a mandatory document where as due to the flow of information on the guidance it can come across as a requirement for Ext to applicants.

you’ve read the statement of changes.
You can read the the immigration rules. But then the rules are stated in the guidance. You could get an opinion from an immigration lawyer.. some might answer for free even.
I feel it’s a very minor thing.. even if I wasn’t sure I would still send it than to risk an interview or a delay..
We all have the best interest at heart of all the applicants when replying!
Ps it’s clearly stated in the guidance!

Thank you for your kind reply at least it seems you are not upset with the post and understand the problems of this route.

As for as immigration liers (Lawyer) concerns I am the big victim of these people so that I applied without any help my initial visa, extension and also Ilr as well. To be honest I was not aware of this kind of immigration boards that is really helpful. I do understand that where a lot of peoples have opinions then some could take things in a wrong way but still happy that because of this post many might be cleared.

Could you please mention the email address OR postal address to send these required documents, also guide that I have proper job description booklets for every job, do I need to send those OR just to write on a paper. Please also guide that as I have 5 employees working at the moment while I sent only 2 employees details to the home office, Do I need to send only for those 2 employees or all of them roles?

Job description of the jobs ur claiming for only..
A booklet might be too much.. I would suggest bullet points/paragraph each of the role.. as there is no example.
As this has just been added to the guidance within a paragraph and is third on the list I reckon it does not require a massive contribution.

I do not want to upset you with my previous post. Apologies if I came across like that. Just to reiterate what Aman already said. Moderators like Zimba and Marcnath have already confirmed before that these changes came into effect as of 29th March 2019.

I understand its not very clear from the guidance if it comes under the ILR route also.

Having said that, its only 1 page, simple brief description. Nothing more. If I was you I would play safe. Worst case scenario if someone is refused just because he did not fulfil this minor requirement it will be a regret for life.

As I do not like any risks with HO, I would advise you to send via post as Aman posted above. Any document sent before a decision is made will be considered.

Some members who have reported recent success and applied after 29th March 2019 did send this description and were approved.

As its a new requirement no one on this forum can answer 100% if it is required or not. But when we advise to send it, its just we want you to play safe.
