ILR long residence question

Hi,

My nephew is 24 year old living in UK for more than 8 years with his parent on child dependent visa. If he moves to Tier 4 (Student Visa) or Tier 2 (Sponsorship Visa) after 2 year, can h apply for Long Term Residency ILR

Thanks for your reply.

The tool does not explain what will happen if he changes his status. For Continuous Residence below is the eligibility requirement

You must have permission to stay (‘leave to remain’). This can be in any immigration category, or a combination of different immigration categories.

You must also have:

been in the UK legally for 10 years (known as your ‘continuous residence’)
kept to the terms of your UK visa


As I said he is on child dependent visa for 8 years and if moves to student visa for 2 more years, will his move still be counted as legal.

All visas count for ILR based on long residence, even visitor visas.
