FLR (DL) Leave Outside immigration rules LOTR

Hi
My family were granted DL under LOTR on june 2013 after a fail asylum application . So twice we received leave to remain which came to an end .Our legal rep advised to apply for ILR with Set(o), which we did separately but i received an email from HO directing me to apply using FLR (DL). Do you think we can still apply for ILR as the 10 year route is not completed ? Thank you and i appreciate any one help on that matter Regards

FLR DL is the correct form for ILR if you are a failed asylum seeker. Set(O) should not have been used.

Now that i have filled the correct form FLR (DL) I am asked to make a payment . Is there a way to put the application through as the HO still has the previous payment i made ? I am do not have anymore money and even paid for premium service on the wrong form , i dont know what to do
