Switching from Tier 2 to ILR with job change and notice period

Hi All! I searched through but couldn't find my exact situation. I am currently under a Tier 2 sponsored visa and am now eligible to apply for ILR. My issue is that I currently have a job offer where they currently do not have a COS as they are a large company and in the process of switching their license from one company to another within their group of companies. I understand the ideal situation would be to switch to a tier 2 at the new job and then do ILR. I have a 6 months notice period and would like to switch directly to ILR during my notic period so that I am then eligible to work for any company after my 6 months notice period for my new job.

My specific question is regarding the employer reference letter as I believe they need to day you are currently still needed for your job. I have no idea if I will be put on gardening leave or work my notice period, both are a possibility. However theoretically I would still be needed for my position during my notice period.

Anyone have experience with this or suggestions? My new employer is happy to provide a reference that I am needed in my new job and would have continuous employment.

Your new employer letter is completely irrelevant to your ILR under your current tier 2 sponsor.

You must meet ALL the requirements with your current employer to qualify for ILR and have the supporting documents.

Your best bet is to apply for ILR with the letter from your current employers and then hand in your notice. You can always go via the premium route to get your ILR in 24 hours
