ILR 10 YEARS LONG RESIDENCY APPLICATION QUESTIONS

Hi guys, I am newly to this group and would appreciate if I get some answers ILR SET LR application . Here is a brief 10 years history of mine:

1.Came to UK 01 SEP 2009 tier 2 student visa valid until 30 Nov 2013

2.Applied for Tier 2 (G) on October 2013 but application was refused with appeal rights due to errors on COS but 4 months later appeal granted in April 14 and got a visa valid till 30 Nov 2016.

3.In meantime switch to ***Spouse visa (5years partner route) on Jan 2015 **(married to a British citizen ) vaild till July 17.

4. Further extended the spouse visa leave and valid till Feb 2020.

I also have a baby, born 2 months ago.

As my 10 years will be completed on end of August 2019 and want to apply via 10 years lond residency route. My questions are

1. Am I eligible to apply under 10 years long residency route even though I was under 5 years parter route (starting from Jan 2015)?

2. Is my visa application refusal (Tier 2) in 2013 ,will have any issue with this application as I didn't overstayed.

3.I am using set LR application, and on the application I ticked that I have a children and asked for documents - both birth certificate and a passport on the checklists box. But I only have a birth certificate as she just born 2 months ago. If I don't tick both the tick boxes application doesn't proceed. Should I tick both and explain on supporting cover letter. What's the best course of action?

1. Yes because under 10 years of long residence route all visas are counted.

2. If appeal was lodged in timely then you should have covered by section 3C which doesn't break the continuity of legal residence.

3. If you cannot proceed then tick both and add a covering letter clarifying it.
