Hi all,
I am Calvin and would like to ask if the example below would counted as a gap on my 10 years continuous residence in the UK or making any bad effect?
I was holding a Tier-5 visa from 26th July 2017 and it was ended on 5th June 2019
However, a company that i worked for is applying a Tier-2 visa for me
But the visa application on their side was refused due to insufficient information provided. So i have been staying in my home country for around 3 months now and they are re-applying on progress at the moment.
Just wondering would it count as a gap on my 10 years continuous residence in the UK please? Or if there is anything i can do about this?
Thanks all

If you will return back within 6 months then your continuity of legal residence wont be broken.

Hi aman90,
I thought about it but i think while the company is applying Tier-2 visa for me, if i try to enter the UK. Both things are not going to work well. The immigration desk in the UK is the difficult part. Thanks for your advice anyway.
As long as i don't spend 180 days or more in my home country before the Tier-2 visa is processed and back to the UK. I think the 10 years continuity should be fine right?
Thanks all

I don’t know how this tier2 visa works tbh..
Aren’t YOU supposed to apply for it after obtaining the necessary paperwork from the sponsor?
Visit visa and tier 2 are two different visas..
One is immigration.. the other is tourism.
My point being a back up is always a good idea..
I just hope there is no delay in the process.

Ok. So as long as you return to the UK within 6 months of leaving your continuous residence will remain intact
