First of all, sorry for a long post but I think I better tell you the whole story with the hope if any of you have the same experience.

I and my daughter first arrived to UK on 02/08/2014. She completed her A level last year and got an offer from the University but we can't afford to pay International student fees so she had to take a gap year and wait till we have ILR to be qualified as home student.

On 02/08/2019, after being in the country 5 years, we applied ILR using super-priority service with the hope that we can have settled status within a few days later (before 1st September) so that my daughter can be qualified for home student fees.

Our appointment with Manchester UKVCAS centre was at 09:00am on 16/08/2019 cause we couldn't manage to book earlier. We got the email from UKVI on the same day (in the afternoon) saying they need copy of UK NARIC letter confirming that my degree was taught in English which I did uploaded into the UKVCAS system but somehow UKVI doesn't have it. So I sent the copy of UK NARIC letter to UKVI again. Then I got the reply straight away that my UK NARIC letter only mentioned that the course is "English program", not "was taught in English".

I rang UK NARIC, they said the UK NARIC letter I have is old (since 2014). Their system has been changed. Though my profile was still on their system but it's read only. They advised me to re-apply again. The new system requires a letter from my university confirming that "my course was taught entirely in English". I then contacted my University but they were being so difficult and too slow. I couldn't wait cause UKVI only gave me to 30/08 to submit new UK NARIC letter. So I booked a B1 test with Trinity college London on 21/08. It says certificate usually delivery within 7 days after the test. I also email UKVI and they gave me extension 28 days to submit either UK NARIC letter or B1 certificate.

On 23/08, I got the email from Trinity college with Unique Electronic Reference number. I was hoping I could get the certificate yesterday or today latest but I still haven't got it though they said the certificate was posted on 27/08 with Royal Mail 1st class.

I rang Trinity college again this morning. They advised me to quote the Unique Electronic Reference number to UKVI so that UKVI can verify and make decision faster.

I did as they advised, quote the number to UKVI, also telling them why we desperately need settle status on 1st Sep as latest. There is no feedback from UKVI so far.

Is there anyone out there can tell me if you have the same experience? Do you know how long it normally take for UKVI approve ILR after submit more docs as their requirement? What is the "date" on the ILR? Is it same date when they approve?

I really hope the date would be 1st September latest. My daughter is so depressing at the moment. She doesn't want another gap year. She really wants to go back to study.

I am afraid you could get into trouble here. UKVI often refuses to accept new evidence submitted after the application like a new English language test evidence. The were several reports of refusal recently on the same subject. I suggest to write to the case worker, explain that NARIC has changed their procedures and request them to exercise evidential flexibility and accept your new evidence. Quote this paragraph of the KoLL guide:

You must then write to the applicant explaining that the Home Office is unwilling to
accept the test or qualification as evidence that the KoLL requirement is met and
give them the opportunity to re-sit the KoL test or take another B1 level test.

Thanks for your advice.

I, in fact did email UKVI case worker to update the status that I did contact my university for the new UK NARIC application but my university was being difficult and response very slow. I am not sure if I can get it with the time frame she gave me which was before 30/08. So while I am waiting for the letter from University, I still booked for B1 test in the mean time. The case worker then replied to me saying she understands and give me 28 days extension for either UK NARIC or B1 certificate. I quote her email as below:

“Thank you for your email with an update.

I understand it may take a while for you to obtain the relevant documents from your university therefore I am now allowing you 28 calendar days from today’s email to provide the second UK NARIC letter – confirming the degree was taught in English.

Regarding the Trinity B1 exam, we can only accept the final result which is confirmed by the certificate and verified by Trinity College London, therefore we would need to see the copy of the actual certificate. However again, we can wait for it and give you 28 days to submit it.

I hope this helps.“

With this email from the case worker, I have enough time to get the B1 certificate but it’s my daughter student fees is my bigger concern because we really can’t afford to pay for international student fees.

Ok so I am not sure what are you asking here really. You have been advised exactly what you need to do by the case worker. Send them the copy and ILR should be granted in no time

As said, my big concern is what date will be on the ILR because it affects my daughter's student tuition fee. She wants to study but we can't afford to pay for international student fee.

Will the case worker accept my English test result with Trinity college's Unique Electronic Reference number which she can verified with Trinity College. I still haven't received the original certificate sent by Royal Mail.

There is nothing wrong with my daughter's document. Can they approve ILR for her first? I have no problem to wait but my daughter can't wait.

ILR will be dated from approval date.

Your daughter won't be granted ilr independently of you. You need to be approved for her to be approved.

Hi Zimba,

I have just gone through the link you gave me about the KoLL guide. On top of page 15, it says:

"However, you do not need to see additional confirmation from NARIC where the:
- Home Office previously accepted a degree qualification as meeting the requirements for an earlier application, and leave was granted"

My UK NARIC letter was accepted twice by the Home Office. First time was first entry visa in 2014, second was 2.5 year leave to remain visa in 2017. I did mention this to the case worker but got no answer from her.

If I understand correctly, I have the right to appeal if the ILR is issued late or rejected, don't I?

Update:

B1 certificate has just arrived. I have sent copy to the UKVI. Finger crossed.

BIG UPDATE

I have just received email from the case worker saying that our application has now been granted. We will received letter and BRP via post due course.
