Job creation enquiry

Dear Gurus,
I have two employees, both are British, one of them is working in my company's branch abroad, and I pay his monthly payments in his UK bank account. He is working 35 hours a week, and his payments are more than the minimum wage rate.

Can I use that job in my ILR application?

Probably best if you use someone actually living in UK..

And pays taxes in the UK.

Putting money in an account is not per se a job creation in the UK.

I assume OP is paying employee’s taxes in UK via PAYE.. that is how job creation is verified.
Interestingly such an employee (working abroad) can claim back taxes later on.. so that would defeat the purpose of hiring a settled worker.. no use to the economy..

The contract is 9 months, he spent 6 months abroad, and the last 3 months will be in the UK, he is not eligible to claim back taxes.
Please advise

Seems logical to me.
If you can explain him easily, if interviewed, then you should go ahead with it.
