Hi All,

I came to the UK in Dec 2014 as software engineer but lost my job and my last day was 31 Aug. 2015.
After that, I stayed at UK and got another job (with sponsorship and visa issued) on 15th May 2016.
Now, in Dec 2019, it will be 5 years since my first entrance. Can I apply for ILR or not as there is agp. if not, can I extend my visa to meet the 5 years rule ? how is the 5 years time calculated anyway :?

Thanks in advance

I suggest to get an SAR. Are you sure your visa was not curtailed in 2015 ?

oh, this is the first time I hear about SAR. will apply to this online.
What would be my situation if my visa curtailed in 2015 ? can I apply for extension till I complete 5 years starting from my last correct employment (May 2016) ?

I suspect your employer failed to inform HO otherwise your visa should have been curtailed. The SAR should show that but given you switched to a new employer, this may never have happened. The chances of getting ILR could be low now as you did not work between August 2015 and May 2016

I see. this leads me to my last question, would be possible for me to do 5 years starting from may 2016 ?
I know that tier 2 can be up to 6 years but is it from first time entering the country or 6 years in job ?
Any advice is appreciated

The 6 years starts counting from when you got your first tier 2 in 2014.
