ILR for wife on Tier 1 Ent Dependent

Hi Moderators

Can you please guide me what are the requirements for ILR application for my wife - I was on Tier 1 Ent and I have ILR since August 2019. Her ILR is due in Jan 2021. Is there anything like income threshold £18,600 ?

If not, what will be the requirements. ?

So following is enough for her ILR application ?

1. Passports
2. Life in UK Test
3. English Language Proof,
4. Two years evidence of cohabitation in both names
5. My bank Statements for 12 months
6. Marriage Certificate
7. Wifes BRP
8. Maintenance
9. IHS

5, 8 and 9 not required. There is NO financial or maintenance requirements or IHS for ilr.

Dear Moderators

I am currently on ILR and have applied for my Naturalisation.

My wife was issued a Tier 1 Ent Dependent visa on 29/02/2016 and came to the country on 18/03/2016.

When earliest is she eligible to apply for ILR. ? I assume 28 days before Visa date i.e 01/02/2021. Correct ?

Hi CR

Thanks. Missed this earlier thread indeed.

I was reading thru application website of UK Home Office, it says following.

When you apply for settlement, you and your partner must:

be living together in your own accommodation
not be using public funds

As an ILR holder, i did receive UC. Had earlier QnA with other experts and they were of opinion it wont affect my wifes ILR.

This is a bit contradicting. Can you guide ?

If you have Indefinite Leave to Remain or British Citizenship then your able to claim any benefits you are entitled to as long as your migrant partner or children will not increase the amount of benefits you are receiving. For instance if you are already receiving £200 per week in benefits and after your partner in added to the equation your benefits do not increase then you have no problems claiming your entitled benefits. It is important to understand that when you apply for benefits they will be in the British or ILR holders name, but the application must be filed to show that the migrant partner is part of the household as their income etc. must be taken into account.

Well, isnt that for Claiming Beneifts.

I am talking about the para that is on main page of ILR application. See below.

Here there is a statement that says
"When you apply for settlement, you and your partner must:

Am I missing something here or in the guidelines that say, there will be no effect on Dependents ILR if Partner with Settled status recieves UC.

Also, I am filling Set(O) form for wifes ILR. Is that the correct app form ?

While in application form, I saw a question in finance tab as below

"Do you or anyone else who is part of this application receive any public funds?
(Required)
Include details for your partner or child if you have one. Examples of public funds include Income Support, Child Benefit, Housing Benefit, Council Tax Benefit, Carer’s Allowance and Disability Living Allowance. See a full list."

Obviously I am named on the application as husband. Does it mean I am part of this application ? if so, do I have to declare all public funds received.

Also, for English, she has a valid IELTS for Academic testing. Does she have to take IELTS for UKVI for the purpose of application ?

Yes set o.

No to benefits question. You are NOT part of the apllicsiron, ie applying.

She needs English B1 for ilr.

So I did a little research and saw other threads by other users in regards to public funds query and its clear now. However please add if there is anything you would like to.

Following questions now are left that I would request your expertise in

1. For English, she has a valid IELTS for Academic testing. Does she have to take IELTS for UKVI for the purpose of application ?

2. Is the Set O right form. ?

3. Any premium service available at the moment for ILR applicants ?

4. She spent about 6 months and 20 away from home in 2018. does it affect her ILR ?
Any no of days policy applicable on her for her ILR ?

1. No, it is currently suspended.

2. Depends when her last/cutrent visa was issued on whether the absence limits apply.

Her last/current visa was issues as per BRP on 18/10/2019.

For background,
First Visa issued 29/02/2016.
She came to the country on 18/03/2016.
Extension with me in 2017 October
Second Extension 2019 October.

She was absent from the UK between 18 Dec 2017 - 22 Jul 2018

Does that affect ILR ?

I am in same situation. Going to apply ILR as Tier 2 dependent in April and confused about this question since main applicant is claiming child benefits after acquiring ILR. Can you please guide me what is the best way to handle this question.

HI CR/CULLINAN / EXPERTS.

I am applying for ILR of my wife. Following is her history. My question is, do I need to declare all the absences of my wife from UK in her ILR application.

First Visa issued 29/02/2016.
She came to the country on 18/03/2016.
Extension with me in 2017 October
Second Extension 2019 October.

She was absent from the UK between 18 Dec 2017 - 22 Jul 2018.

What absences do I need to declare ?

Documents
1. Applicant Current BRP.
2. Photos of 2 Older BRP's of applicant
3. Current Passport.
4. Old Passport
5. All stamps pages on passports.
6. Signed consent form by myself.
7. Signed consent form by applicant.
8. My ILR BRP.
9. Since I recently changed my address 1 month ago, my recent tennancy agreement.
10. Proof of address on wife's name for Oct 2019-2021 Jan
11. Proof of address my name for Oct 2019-2021 Jan.
12. Combined Cohab proofs.
13. Marriage Certificate.
14. LIUK Pass screenshot as there was no certificate issued.
15. English Language CEFR Level B1 Certificate
