Seeking Advice: Calculating Continuous Residency for ILR Application

Hello everyone,

I hope you're doing well. I have a question regarding the calculation of continuous residency for an ILR (Indefinite Leave to Remain) application in the UK. I am currently a refugee in the UK and obtained my refugee status in November 2019. I plan to apply for ILR in October 2024.

Specifically, I'm wondering how the 12 consecutive months of continuous residency are calculated. Could someone shed some light on this matter? I'm unsure whether they calculate backward from the date of my ILR application, from my last travel date, or from the beginning of the five-year permit I have.

Any insights or information regarding the calculation process would be greatly appreciated. Thank you in advance for your help!

You need a min of 5 years minus 28 days. So you use the date your visa was approved + 5 years - 28 days. That will be the earliest day you can apply for ILR. There is no specific absence limit but you need to have lived mostly in the UK for the last 5 years.
