Tier 2 Dependent ILR Set O application issues

Hi All,

We have submitted the Set 0 ILR application for dependents. After 2 weeks of waiting, I have received the below update from Home office.

You have made an application for settlement in the UK as a dependant of yourself which is not possible.
You must now re-apply and ensure that if you are applying as a dependant partner, you enter the details of your partner under the sponsor information section.
If you do not wish to apply as a dependant partner, please choose a different application type and apply under that route.
Once we have received a fresh application, we can void this application and return any appropriate fees as per our refund policy.
Please note that any other dependants listed on this application will also need to re-apply with the correct sponsor information.


I am filling the new application, Can you please help the actual mistake they are highlighting in the response. I am not clear and the confused on what went wrong. Also, the dependents BRP has expired. Can we re-submit the application with the cover letter for the BRP issue. ???

Also, please confirm the refund process for the first application. They refund the full amount including the priority fee??

Who is the main applicant or who is the sponsor?

Thanks for your response. My wife is the
main applicant with Kids. I have received ILR last year and sponsor for their application.

In the home office response they said that refund will done. How much will be refunded and what is the procedure?

Also, do we need to mention the old application number in the latest one?

Last time, I have missed to give my details in the sponsor section. Is there any other details needs to included in the wife and kids application with respect to the mention issues by home office?

Also, do we need to book the biometrics appointment as well for the new application or just submit the application and reply to the mail and the will use the existing biometrics provided?? I am very confused in this.

Pls advise to complete the application.

Your dependents must apply on their own !! Your spouse will be the main applicant and the kids will be added to the same application. UKVI knows all the details of your relationship, you do not have to tell them things they know about you.

They must re-do everything. Apply again, pay again and do the biometrics again :!:

Thanks again for the clarification.

We have applied my wife as a main applicant, but in the sponsor section (The person you are joining or accompanying) we have entered my wife name which is wrong.

Now I am filling the new application with my details in this section as my ILR will be the sponsor for their application. Hope this is correct??

Can you please confirm if anything I am missing with respect to the issues identified in our previous one.

Thanks for the reply, I will complete the application for them and book biometrics.

One more query, I need to choose Tier 2 General in my immigration status while filling the application. I don’t see any options like ILR to show my immigration status.

Also, pleas confirm on the COS details. As the ILR was granted for me, I don’t need to give the old COS details in the dependent ILR application?

Tier 2 or skilled worker yes.

You must put your last cos details in the form as asked.

Does the period of stay on which this application was based include any leave granted since 11 January 2018?

Have you had any absences from the UK during any leave granted since 11 January 2018?

Her initial visa was granted Jun 2017 and we have done the extension on Jun 2020. She took absence for 20 days in Sep 2019 and no absence after the extension.

Can you please inform me the answers for these two questions in the application.

Thanks for your valuable inputs. I guess the below one is my last query, please help me on this.

As mentioned earlier, I am submitting the application as a corrected one for the earlier application and giving the earlier reference number in the first page of the application.

Do you currently have an application with the Home Office for leave to remain for which you have not yet received a decision? Yes
Provide the reference number for this other application

I can see the similar question in the later section as well. Please confirm, do we need to give the same details here or any old GWF reference needs to entered. Also, is it mandatory to give any reference in the below section. ???

Do you have any Home Office reference numbers?

Also, is it mandatory to submit the cover letter to Vary the application from the existing one. Please provide me the sample format if i need to submit the varying cover letter.

ILR Biometrics Appointment queries

Hi All,

Thanks for your help and I have submitted the ILR dependent application for wife and kids. Due to issue in the earlier application for their ILR, i have filled new one and submitted.

I don't see any free appointment for two weeks to provide the biometrics. As mentioned, this is re-submit application (after BRP expiry) do I need to booked the paid appointment and finish the biometrics process fast or fine for two weeks waiting for biometrics.

Please confirm me on this one. Thanks in advance.

Your dependant's leave remains the same since the applications already were submitted.

The biometrics appointment can be booked anytime from now: in a few days, weeks or in a month. Choosing a free or paid appointment (of course depending on availability) is purely a personal decision. The key here is doing so within the timeframe given by UKVI in the application.

Hi All,

Home office responded our previous ILR dependent application with the errors in the sponsor details. As per the guidelines, we have filled new application for the dependents and awaiting for the Biometric appointment.

Can you please help me to provide the sample cover letter for the second application to submit along with Biometrics.

There is no varying form. While filling the new application you will be asked if you have an existing application that is yet to be decided.
Answering YES then indicates it will be varied and consideration of previous or existing application stopped.

You cannot have two pending applications as per law, so if you apply for a new application (while having a pending one), the new application is viewed as a variation of the previous one

Hi Friends,

Thanks for your help in the ILR department application. After the second submission the application was successful. Thanks again.

I have received a mail from home office like our previous application has been voided and the refund will be processed within 28 days. But I haven’t heard back about the refund. Can you please help me to apply for the refund for our earlier application which is submitted wrongly and voided with the new application.
