Hi,

I recently got my ILR on 10years LR route. My wife will be completing her 5 year on SW visa in Aug 2024. My son is 8 years old (born outside UK) and have been in UK since he was 6months old (came on dependant visa).
Since i got my ILR :

1. Can i apply for ILR for my Son? His current Depandant visa is about to expire.
2. Do we need to wait till my wife also gets her ILR next Year?
3. If so how do i extend my son's current dependant visa?

Would be grateful if someone can help me with above questions.

PBS dependent route is not technically correct as Tier 2 and most PBS visa routes do not exist anymore. It should be the skilled worker dependant route

The new rules allow this, they changed earlier this year.

The apply for PBS dependant extension page says WITHDRAWN. Also somewhere it says the extension would be min 3 years (that means i have to pay NHS charges for 3 years ) where as my son will be eligible for ILR in Aug 2024 (so will be my wife, she will be completing 5 years on her SW visa). So is there any other way/route where i dont have to unnecessary pay for 3 years extension for my son??

You apply for a skilled worker dependent visa.

The childs visa will expire at the same time as your spouse and you MIGHT be able to request a refund if the extra ihs.

You cannot choose to apply and pay for less than 3 years. This is dictated by the immigrstion rules

ILR clock does NOT reset for skilled worker dependants when the main applicant settles under the long residence
