ILR Application Query

Hi,
I have continuously stayed 5 years in UK under Tier 2(PBS) dependent category .My husband is already a ILR holder. As i am now eligible for ILR, which route do i need to apply for ILR application? I could see SET(M) and SET(O) applications and i am confused which is the correct route to apply for my ILR. Can anyone please share the correct link for the application?

You can only apply on Set O.
The form you use is dictated by the visa category you hold, not your spouses current status.
Withdraw ILR Application

HI,
My current ILR application is on hold as i need to resubmit a new application. I am on 3c leave now. I have applied through wrong route which i why home office suggested to reapply with correct route. I have been also informed that i would get a refund once i resubmit the application and then they will withdraw it. I would like to know if i am not resubmitting the application rather withdraw it, will i still get the refund? Also if i return to my home country after withdrawn the application ,my 3c leave will also be withdrawn then how long can i stay in uk ?

When did your visa expire?
Why do you not want to make a new application on the correct form? You were advised in 7th november which form to use so unclear how you still submitred on the incorrect form.
If you withdraw your application, you likely lose the fees and your section 3c ends and you become an overstayer if your visa has already expired.

Don't withdraw, submit on correct form as earlier advised

So reapply. Not sure why you want to withdraw and leave the UK when you simply need to reapply on the correct form.

I am currently undergoing financial difficulties and to reapply i will have to pay the fees again and since the Visa fees is increased now, for me and my child i need to pay almost £6000. The refund will take almost 28 days to come. I would like to know one thing in that case ,like can i apply for a family visa instead of ILR? Since compared to ILR ,Family visa for both of us will come around only £4500 and also need to know if i apply for family visa ,will i still get the refund ?

You may vary your ILR to any application like FLR(M). Note that will reset your 5-year ILR clock under the skilled worker dependant route to zero. You have to start the ILR time from scratch under the family route and your ILR could be delayed by around 5 years and in the long run will cost you way more given the regular visa and IHS fee increases. You also face the
potentially huge increase in the income threshold under the family route from next year, due to recent proposed changes to the family visa route

Thank you so much for the detailed advise. In that case i will apply for ILR itself. One final thing i would like to know, Since i am reapplying for the ILR application will that count from the start to get a decision(6 month of waiting) or is it like i will get a decision based on the application i did on 3 months back even though it has been asked to resubmit?

A variation will be treated just like a new application, so it is like starting everything from scratch

My partner is already holding an ILR and now I am applying for ILR using SET O form. I have chosen tier2 dependent category and later it leads to a questionnaire in which it was asking for my partner's current immigration status .I have only choice here to select tier2 general .(There is No choice to ILR in this options even if my partner currently on ILR) . ie: with respective to current status, ILR is the right choice which is not available .Only the previous status is available .
Just want to confirm that I have chosen the right option.

I already got my ILR in 2019 through tier 2 general and now applying only for my dependents ( wife and daughter )
Is there financial requirement , while applying ILR only for dependents ?
(I can't find any such thing while I search in home office website)
While answering the questionnaire for ILR application , I have few doubts. please clarify the following.

Which visa is the person applying for or been granted?
Tier2 general or ILR?
Question in the form. Do you have one of these reference numbers for them
Yes, I have their Home Office reference number
Enter their Home Office reference
Tier 2 application reference or ILR application reference number ?
If i am giving the answer Yes, I have their biometric residence permit (BRP) number
And Enter the BRP number
Which BPR ? ILR BRP or old tier 2 BPR (which is not valid now )

Please do NOT start a new post for each question regarding this case. Stick to this thread ONLY
All the BRP and other details can be your ILR details. UKVI knows everything on their systems so do not worry much about these

Hi,
As my current Tier 2 PBS dependent visa expired and I am on 3c leave now .In my new ILR application asking for Evidence of my immigration status in the UK, what should i submit as proof for this?
Please Help

Just say BRP as when you originally applied. UKVI knows the rules and has access to your data
