Prorated hours on skilled worker visa

Hello Team,

Asking on behalf of my friend:

His employer applied for COS based on 30 hours per week (prorated), salary as per COS is 20 K under the office manager category. The minimum salary requirement was 25,650 on 37.5 hours as per the home office.

He is worried as the minimum requirement of salary for ILR is 26,200/-.

Can some one confirm, will less salary impact on his ILR when it is due as the home office approved the COS?

There are two requirements to fulfil. See: indefinite-leave-to-remain/ilr-minimum- ... l#p2027869

If the SOC says min £25,650 on 37.5 per week, then for 30 hours per week that will be pro-rated to £20,520 so you cannot become eligible. You need to get paid more than that because the min general threshold is £20,960 but this could be higher, as it depends on their trading option according to their SOC.

What is his current salary, working hours and SOC ?

His pro-rated going rate for 30 hours per week will be £20,000 but that is not enough for ILR as he needs to be making at least £26,200:
Salary equals or exceeds the higher of:
•£26,200
•Going rate for the SOC code
•£10.75 per hour

Then how come Home office Issues COS and person got the VISA?

The salary threshold to get ILR is NOT the same as getting an entry clearance. :!:
ILR has a min general threshold you must fulfill to get ILR. You are also not entitled to ILR, you should demonstrate that you can qualify for ILR

Only employment with the visa sponosr counts for ilr. So no, he cannot do "20 hours elsewhere" for another employer to qualify ILR.
