Spouse ILR Absence

Hi moderators.
Thanks for the good job you people are doing .
I'd like an advice on my situation.

I am a British citizen, and ny husband is on 2nd hand of his 2.5years spouse visa which will be expringing in summer of 2026.His cureent visa was issued in Feb 2024 when he switched from parent 10 year route to partner 5 year route .Airport parking services

I have a dilemma and would likely ask for you people suggestion.

He last applied for his spouse visa alone as he met the financial requirement in addition to using the utility,marriage cert etc and this was issued .

This year, I have struggled with job here as a doctor but was lucky to find a job in Canada, so I have been shuttling months on and off.
I still work here and has not declared myself non resident as family -hubby and children are all in the UK.

My husband is currently doing his Mental health uni in UK and will be finishing summer of 2026.

He has not been away from uk for more than 180 days.

My question is does my shuttling between canada and UK affect his ILR in 2026?

We own our house in uk here and everything is same except that I'm on and off .

Does not shuttling or absence from UK affect his ILR?

Will homeoffice know even when nothing has been declared?

Just need to plan on time .

On what basis is your partner planning to apply for ILR in 2026?

What is the immigration history?

There is no such thing as "180 days absence limit" for spouse visa holders.

He is going to apply as a spouse of British citizen and that what he is curently on .He is on his last 2.5 years of spouse visa and will be due for renewal in 2026

He is currently working and doing Bsc nursing as well.

Just wanted to make sure that ny in and out of UK for work wouldn't impact him getting ILR in 2026
