ILR Eligibility for Skilled worker Dependents

Hi there,

I hope you are doing well!

I have now received my ILR through the 5-year Skilled Worker route and would like to know the eligibility criteria for my dependents.

My wife and son moved to the UK in February 2019 (my wife as the main applicant on a Tier 2 ICT visa, and my son as her dependent).
In November 2019, I obtained a Tier 2 General visa, and in May 2020, I applied to switch my wife and son to my dependents (within the UK). However, due to COVID, the decision was delayed beyond the standard processing time, and we received the approval in November 2020.

I have a couple of questions and would appreciate some clarification:

Can the visa processing time (May 2020 – November 2020) be counted towards the 5-year qualifying period for ILR?

Since my wife was previously the main applicant on a Tier 2 ICT visa, does she still need to meet the English language requirement when applying for ILR?

Can the time my son spent in the UK as a dependent on my wife's ICT visa count towards his ILR?

Did your wife previously meet the English language at B1 ? If yes, then the previous evidence can be used

Children do NOT have a min residence requirement. They settle when both parents settle. He simply settles with your spouse
