Earliest date to book Biometric appointment for ILR

Hello

What is the earliest date to book Biometric appointment for SWV-ILR route of 5 years

My Decision email :24th Sep 2020
BRP issue date: 20th Oct 2020
Vignette stamp start date: 3 Nov 2020
Physically entered in UK on: 15th Nov 2020

I submitted my application based on my BRP date on 30 Sep. When should I take BRP appointment?

I have taken it on 9th Oct, should I reschedule it to 18th Oct (28 days backwards from 15th Nov) ?

Please help as I was reading some posts which says count 28 days back from Physically entry in UK

Earliest date of ILR eligibility is 20th Oct 2020 + 5 years - 28 days.
That is the date to aim for biometrics. Date of entry is irrelevant under your route

Thank you Zimba. My lawyer told to take as per my physical entry. I see the link you have shared. So want to go as per that as I see some successful stories where you have suggested them to go as per BRP issue date.

Just wanted to double confirm as my lawyer told physical entry date.

Immigration system is not an experience based system, it is a rule based system. You do not just apply and hope for the best because of successful stories. They were successful as they followed the rules. You need to plan your application as per the immigration rules in place too. Any advice given should be based on these rules

Your lawyer is talking rubbish, given they do not even know the rules under the Appendix Continuous Residence:
The time between the grant of entry clearance and the date of arrival is a
period during which they had permission on that route and should be treated as a
period of lawful residence
. In these instances, you must establish the date the
applicant entered the UK. The time between the grant of entry clearance and the
date they entered the UK counts towards the total of absences.
