ILR issue (5-year dependant route) urgent

Hi,
My scenario in brief as a dependant of british citizen,
->FLR(M) applied in aug 2020,decision letter came on jan 2021 stating permission granted for 30 months,
but BRP issued upto April 2023( wrong date has been issued instead of july 2023 they printed for only 27 months),
-->FLR(M) extension later in march 2023 i have applied for extension,visa issued for 30 months till (1/11/2025)
now i am in short of 3 months to apply for ILR.
since its purely BRP error can i apply for ILR stating in letter clearly what has happened.
if not can i apply for FLR(M) extension visa agian which is costing more at the moment.
Please advice.

You need to apply for an SAR to find out when the visa was initially issued.

hi Zimba,
First FLR(M) visa issued from 27/01/2021 to 09/04/2023 (BRP error happened here actual date should be 09-07-2023) without noticing this date error on BRP i have applied for FLR extension.
FLR extension: 13/04/2023 to 01/11/2025
total i am in short of 3 months to apply ILR
here its BRP team mistake
As my current visa is expiring soon i need to apply for visa.
so my question is now can i apply for ILR or not?
please advise,

Regardless of whether this was an error or not, you cannot get ILR as you do not qualify for now. My suggestion is applying for FLR(M) then delay the biometrics for 45 days then apply for ILR using SET(M) to vary the previous application and again delay the biometrics until you are within 28 days of completing your 5 years. You should get a refund for any fees paid towards the FLR(M) application later on

hi Zimba,
just a small clarification needed,i will make flr(M) application and delay biometrics for 45 days,and then please suggest can I give my biometrics or not,if i put ILR without giving biometrics then also i am not qualifying for ILR in total I am in short of 90 days,biometric delay fills only 45 days.also will i get refund of application once i give biometrics.please suggest.

You qualify for ILR 30/12/2025, that is 28 days from completing your 5 years. You want your ILR biometrics to be on or after this date.
Your current visa expiry date is 01/11/2025. You are just 2 months short. Apply for FLR(M) now which is before visa expiry, delay the biometrics for 40 to 45 working days and do not enrol it, apply again for ILR using form SET(M) in December 2025 and delay the biometrics until first week of January 2026.
