Hi All,
Just checking my wife here on teir 2 dependent visa since 2018 and according to parliment statement what I understood it will only apply to those who arrived since 2021 it thats right? we are thinking to apply ILR in Decembe3 2025 will she be okay.
Also ILR ENGLISH TEST REQUIEMENT IS STILL b1 grade speaking and listenning right

No new immigration rules have been announced yet. Until the new rules and proposed changes are formally announced, we can't help you.

Hi All,
As we all know HO trying to change ILR criteria and time period I am british citizen. I came in UK tier 2 general visa and my wife came here as My dependent now because she did not complete her 5 years terms with first visa and second extension for three years I have to apply further three years extension for her so she is here now almost 7 and half years. My question is as she passed her life in the UK test and english B1 grade 5 test can I still apply 5 year route as new changes are not a law yet. I am thinking to apply within two weeks.
I am also thinking to apply on priority which is 5 working day decision or standand application should be okay?

If she has been your dependant since 2018,why hasn't she had ILR by now ?? Why doesn't she have 5 years ?

Hi Zimba,
When she came first time 2018 June she had 1 year and few months visa as I was on tier 2 and that was also my tier 2 visa expiry upto somewhere in 2020 year. I got my ILR 2019. She continued on her visa I applied her extension in 2020 March again because that was her first visa expiry she got three years extension upto March 2023 if we add all now 7 months of 2018, 12 months of 2019, 12 months of 2020, 12 months of 2021 12 months of 2022 and three months of 2023 total will be 58 months as rough but I remember with exact dates she short of just over three months so I have to apply again 1 more extension which was granted in May 2023 to May 2026 because I paid very large amount for that extension we decided we will apply ILR once this extension about to end now things getting change very quickly I am thinking to apply now

I cannot really understand what you wrote above. Can you provide visa type and dates ?

Hi Zimba,
She came here as my tier 2 general dependent June in 2018 her first Visa expiry was March 2020.
First extension as Tier 2 dependent March 2020 to March 2023 for three years.
If you count above you will find she did not complete her 5 years time she was short of few months so in March 2023 we have to apply another extension to complete 5 years time of course extension was again for 3 years and last extension was granted in May 2023 but we did applied in March 2023 now current extension going to finish in May 2026
And thats her visa history.

What was the start/issue date of her initial visa in 2018??

Hi,
18th June 2018 to 3rd March 2020
Second 24th March 2020 to 23rd March 2023
Final extension applied in March 2023 was granted in May 2023 to May 2026

Your spouse has been eligible for ILR for a long time. You can apply even today and the application should proceed accordingly.
The current immigration rules still apply. The latest announcements are only a proposal.

Your wife has been eligible for ILR since 2023. If you did not come up your own interpretation of the rules, you would have avoided the extension in 2023 altogether. Apply for her ILR now
