Partner(FLR M) to Set(M) application timing

Hello,

Just looking for some advise.

I initially came over on a Tier 5 Youth Mobility Visa in 2019.

On the 26th May 2021 my Partner visa was accepted, i got Partner(FLR M) on 13th December 2023 and that is due to expire on 5th May 2026.

Which means on 26th May 2026 i would have been on a partner visa continuously for 5 years.

But i am a bit confused as my current visa is due to expire before my full 5 years.

My question is, will i be able to use the 28 day rule and apply that to the full 5 year date of 26th May 2026 and apply for ILR between 28th April 2026(28 days before full 5 years 26th May 2026) to 5th May 2026(My visa expiry).

Any help would be greatly appreciated.

Yes.

You can apply for ILR well before the expiry date of your current visa and to benefit from the 28 days concession just need to ensure that the ILR decision is taken on or after 26th May 2021 + 5 years - 28 days.

You do not need full 5 years to get ILR. That is the whole thing about the 28-day concession
