Regarding ILR, please help!

Hi, I am a newbie and I have heard a lot of things about this site as to how useful it is and how many people became successful.

I have a problem, which I need your help and advice.

My problem is this: Firstly, I am a British Citizen. My husband has been in the UK for 6 years. He was on work permit for 5 years. Just before his work permit had expired, me and my husband decided to get married, which we did. He then applied for a spouse Visa and was granted 2 years stay. It has been 1 year into his 2 years of stay with the spouse visa.

My question is this, since it has been 6 years of his stay in the UK, can he apply for the ILR now or does he have to complete one more year of his spouse visa and apply for the ILR then? Is there any other way or form in which we can apply to settle him in the UK permanently? What do you suggest?

Hello Sarah,

I think you are a bit stressed, the be fair with your case no need to worry. The rule is, ' in order to get ILR as a dependent, you u need to spend 2 years in that category'. So wait for that time and apply. As simple as that.

Yes, I am a bit stressed but not that much because if it means that we have to wait for 1 more year, then we will. It is just something that popped into our mind. If you can understand that he has already been here on work permit for 5 years and then 1 year on spouse visa, were just wondering whether there is any way of settling in the UK faster. Though, he is on a spouse visa at the moment, what I am asking is whether he is eligible for ILR in the case of his work permit of 5 years which has finished and 1 year into spouse visa.

But if your suggesting I should wait, then I will, I have no problem with that. I am just enquirying whether there is a faster route.
