ILR Help , applying shortly for ILR but have traffic offence

Hello Everyone,

I am due to apply ILR on 4year HSMP JR rule, its due in first week of march and I have appointment on 18th Feb 2010.

Everything is fine but I am in a small situation now.

In Nov 2008 one of my frnd took my car to go b'ham and traffic speeding ticket followed to me as I am registered keeper of the car.

I have spoken to my frnd abt that, he said that he might have done that as speeding offence was caught on Temp Camera for road works.

Following that i filled up the form with driver details as my frnd , police send letter to him after that. My frnd informed me and advised that he is going to send his details to them.

In June 2009 he returned to his home country.


Even I don’t know whether there was any fine or points on my frnds license as i never asked him since he was feeling guilty abt that already.

After he went back to home country I lost contact with him.

Even I didn’t receive any information from police since I send the form with my frnds details.

My questions are
1. will this effect my ILR application ???

2.Will this effect my citizenship when I am due for it???

Help will be greatly appreciated.

Hi Smilep ,

As far as I know this should not effect you in anyway as you didnt recieve any kind of fine or points on license.

Gurus and experts pls comment , correct me if I am wrong.

firstly i'd check with the police that you are in fact clear of this offence.

i'm pretty sure that in 2 years they would have made a contact with you if this issue was still outstanding but if it worries you too much - better check.

if you're clear - then no worries.

if you are not - you have to mention it on ILR form however it's unlikely that it'll affect your ILR.

however, if you get a court order (before of after ILR) it might affect your application for citezenship but this depends on the court decision.

as far as I know they take seriously major criminal offences or many minors – like regular speed breaking or driving without insurance etc.
still you can be clear of them in 5 year (or is it 4?) when they become “spentâ€

To what i know it wont make any affect on your application as there is nothing against you. The initial letter sent by police (to my understanding) is acceptance of the offence. As you have not accepted but your friend has, he is liable for the offence. I would not worry about this.

I have been in the same situation and my friend accepted the offence, paid the fine with 3 points on his license..
