ILR question never found answer for it

Hello Guys,
I was married to my british citizen wife on 2004 and got spouse visa, when i was applygin for ILR my dad fell sick and i withdrew my application to travel to algeria to see him, so i came back to the UK wiht a new spouse visa which wil lexpire this coming June, i was told that i can apply for ILR anytime during the second spouse visa , but some other guys told me i have to wait for 23th month like a normal spouse visa to apply, guide me through this please

vinny,

my first spouse visa is from 21/11/05 to 21/11/07 ihave spent dur to my oilfield work rotation which is one month on and one month off a period like six months and i submitted my timesheets and letter from employer.
but when i withdrew my application an dtravelled i came back on spouse visa 18/06/08 to 18/06/10and during the second spouse visa also i spend more than 90 days outside uk for work but not at once in different trips,

now i am kinda lost, would i apply in person or by post, and would they consider only the first spouse visa or the second or both , i never came to a situation liek this before

On the basis of just the 2nd visa. That visa started 18.06.08, but what was the first date of entry to the UK, using that visa?

the first date of entry was the 26 -06-08,

OK, assuming the Life in the UK test has been passed by then, apply for ILR no earlier than 28 days before the 2nd anniversary of the date of entry = 29.05.10 ... and no later than the date of expiry of the current visa = 18.06.10.
