My wife has recently entered the country on Tier1 Dependent visa. I should be eligible for ILR in May 2011.

Given this - can I apply for ILR for her at the same time? Though she has not completed even two years (by then)? If not when will she be eligible - given all the rules change in July 2011?

As you are having Tier 1 visa at the moment, your wife will have to wait for atleast 2 years before she can apply for ILR with you.

I dont think she will be able to get ILR before July 2011. (considering she has come to UK in 2010), so the best option for you will be to apply in May 2011 alone, before the rule changes in July 2011.

If you are planning to apply for ILR before she completes 2 years in UK, then she will have to apply for FLR(M) as Tier1 dep. becomes invalid when you change to ILR.

Have the rules remained the same....need to go for an FLR M for my wife for the stub period?

Appears a waste of money for 6-7 months when both our visas are valid until 2012 or alternatively what are my options apart from delaying my ILR application (and taking a risk with any change in rules in the intervening period)?

Yes dependant rule sstill the same.

As you said you can take the risk of waiting for 6 months to save money and risk is change in rules or change in your circumstance (e.g. getting a criminal conviction which will have to be spent before ILR is given).

Please note that the comment in question was made more than a year ago - Mar 2010.

If you qualify for indefinite leave to remain it may be best to apply sooner rather than later.

What is absence rule/clause for 2 year continuous stay? Can dependent stay out of the country for 90 days at a stretch? Many thanks!

I am on Tier 1(WP before) and sent the application SET(O) with my wife's passport couple of days back but just realised that the dependents need to complete 2 years in the UK before applying for Settlement. My wife moved to the UK on Tier 1 Dep only Mar 2010 so just completed one year.

Any idea if they would they take the payment for both of us (around 1500£ now for main+1dep) and then reject the application when they find out abt this or if I could phone them up and withdraw the application. I am paying by Card and the payment has not gone through yet. Please advice.

i think that they will charge for considering your wife's applicaiton and then refuse her applicaiton.

Thanks for the clarification. I think he was referring to 'earned citizenship' plan...
