Hi
I need some guidance on this. I am a working resident in UK since Sept 10th 2006. I am currently holding a Tier 1 visa. In sept 2011, I shall have completed 5 years of stay here in UK. Would i be eligible to apply for a PR then or will the new rules affect me?
If it would affect me, then when would I be eligible for a PR? Also need some info on the new rules which come into play next year?
Someone please help.
cheers
Sona

From the information available as on date, only HSMP migrants who received their (HSMP) approvals as per rules in place until Nov-2006 seem to be protected from the "earned citizenship" changes coming into force from next year.

Hi Mr Mehta
I shall need some more clarity on what you have stated. I was on a work visa from Sept 06 till May 08, and then moved on to a Tier 1 Visa. Would I be eligible to apply for a PR in Sept next year or not?
If not... what is the new process? I am a bit confused about the new rules like temporarly residentship, etc.
cheers

Therefore the new changes coming into force next year (earned citizenship) will affect you.

Keep an eye on UKBA website for more information on earned citizenship rules and roll-out.

Hi
Thanks for this valuable info. Does this mean my initial almost 2 years of stay in UK (thru Work visa) will not be counted as a part of my 5 years, when i apply for permanent or probationary citizenship?
cheers

Two questions. One answer.
No, you cannot apply for ILR in 2011 as per current rules/July 2011 rules.
You will need to apply for probabionary citizenship in 2011.
Hope you don't ask the same question again.
Cheers mate
