Hi,
My wife entered the UK on a spouse visa in October 2008. This visa runs out in December 2010 as it is now valid for over two years.
However, we will be applying for her ILR sometime in September ie 1 month before her 2 year anniversary of being in the country.

My question is this. She is a Canadian and had her passport made before we applied for the spouse visa so is still in her maiden name.
However all documents she has acquired after entering the UK including her UK driving license and all other documents which we will submit as supporting documents are in her married name.
So what I want to know is is it still OK for her to make the ILR application in her married name (we do have a Canadian marriage certificate as we got married in Canada).
Also is it OK for her to take her Life in the UK test in her married name?

My wife's passport is in her maiden name too and was able to present documents in her married name, and a life in the uk cert in married name.

BUT - here's the key - the application must be done in the name in the travel documents - her maiden name.

You must then also include her married name in the 'other names you are known by' question.

Our application was dealt with in person at Croyden.

We never bothered changing my wife's passport as it has a US visa in it - which can be a pain to get hold of - so left it in her maiden name.
