I am quite in a soup over here. Need your valuable inputs for following questions.

Say I entered UK on 18th July 2006 and My visa is valid up to 20-June-2011.

1. For ILR eligibility, will I complete my five years on 17th July 2011 or 18th July 2011?

2. It says I should not apply more than 28 days before the qualifying period? So which would be the earliest date I can apply? 1) 19-July-2010 (17 July -28 days) 2) 20-July-2010 (18-July – 28 days).

3. If I send my application on 20th July by post, will the same date will be considered as date of application or it will be the date home office receive their application?

It might be a simple math for some of you may will be very much helpful for me.

you can apply 28 days before you complete your 5 year. Apply when you have 27 days left to complete 5 years for not to worry about the date of application. The date of application is that the date HO receives the application.

Thanks for your reply.

To make it more simple, I am assuming some hypothetical dates.
Say for example,
(1) If my visa expires on 29th April 10, Can I apply on 01 April?

the reason I am concerned is it seems my last day of leave to remain in UK and the earliest I can apply for ILR falls on the same day.

So, any guidance would really be of great help

thanks

I looked in guidlines pdf this is what it says.
Set(o) form guidlines

There is a qualifying period to complete in most of the categories on this form. It runs either from
- the date on which you entered the UK with a visa in the relevant category; or, if you did not enter the UK with such a visa, from
- the date on which you were first granted permission to remain in the UK in the relevant category.
If you entered the UK with a visa several weeks or more after the date from which it was valid for use, you may need to apply for an extension of stay to complete the relevant qualifying period.

You should have stayed in UK with valid leave to remain / enter for 5 year to apply ILR. Do you complete 5 years on 29th april 2010? If yes, you can apply from 2nd april to before expiry of your visa. I would advise you to apply as early as possible, if something goes wrong, you will have time to get your FLR.

To make it more simple to get proper advice, you should better provide real dates next time.
