Must somebody applying for ILR on work permit basis have leave at time of applying for ILR ?

My nephew's ILR was rejected, he has no leave, can he re-apply for ILR ?

1. Yes.
2. If given the right to appeal, he can do so ... within stipulated time. But he cannot apply afresh.
