ILR Eligibility...5 years time missing..late arrival

Hello guys... Hope you guys are doing well.. I have a concern regarding eligibility of ILR. I am at UK on HSMP... My visa history is as below


Got HSMP: 07-01-08
Enter in UK: 14-04-08
Got Extension till: 07-01-13

As ILR requirement says 5 years continues period stay in UK while I came 97 days late once I got my HSMP visa initially

MY question is how I can eligible to apply for ILR? Do I need to go for an other extension for covering that missing 97 days if yes then I need to go again for the same extension procedure? Coz on that time I will not able to claim my age points .

The 5 years period is counted from the day u enter the UK and not from the HSMP visa start date..
SO you will have to apply for extension in 2013 january..
u can apply in march 2013(28 day before u complet ur 5yrs stay

In all probability, you'll be applying for probationary citizenship (and not ILR) in 2013, provided the residential requirements remain the same under earned citizenship laws.
