ILR for Tier2 candidates

Hello Friends,
Recently (December' 2009), there was a change in the rules for UK immigration that if a person has been on a Tier 2 visa for 5 years, he can't apply for ILR. Before December' 2009, duration under Tier2 visa was considered for ILR.
My question is that if my Tier 2 visa started before the rule got changed (before December' 2009) but, my 5 years got completed after the rule change (after December' 2009), will the old rules apply for me or the new rule will be applied and I cannot apply for ILR?
