Hi Members,

I have some doubts in the ILR Application form.

1) My First Entry to the UK was on 01st April 2004. Went back to my home country and came back on another work permit on the 19th September 2005.
Now that i am eligible for ILR in another months time. I am wondering what date needs to be filled in the section 6.1 which states like this,

" When did you (the main applicant) first enter the UK? This refers to the
date of your first entry in to the UK at the beginning of the period of stay
on which this application is based."

===>> should i specify 01st April 2004 or 19th September 2005.

2) My Spouse is on her own visa. So i am planning to apply ILR for me and my child. Though she managed to clear the Life in the UK test recently. Should this be mentioned in Section 4.3 of the application, where
it asks for whether the partner has cleared the Life in the UK test.

Was the first entry in UK as WP migrant? If som, what was the validity of the entry clearance? And when did you go back to home country?

==>> Yes, It was as WP Migrant.

If so, what was the validity of the entry clearance?

====>> It was until 03rd August 2004

And when did you go back to home country?

===>> I returned to my home country on the 31st July 2004.

Assuming you have been in the UK continuously (excluding allowed absences) since 19 Sep 05, then this is the date you should mention.

If spouse is not applying for settlement as a dependent at the same time as you , and therefore not included in the application, I do not see a reason of why any details pertaining to your spouse need to be included in the application.

Sushdmehta, Thanks for your Reply. Rest assured i have had short absences below 150days with in this five year period.

I have an appointment at the Sheffield PEO office. I am wondering whether i can take my spouse, though she is not applying for ILR along with me. She will be there just to take care of the child. Has any one had similar situations like this in the past?

If you're still a work permit holder, then why didn't your wife get a wp dependant entry clearance and apply for ILR (196D) with you?

Hi Vinny, She is on her own Tier1(General) visa. I am planning to make her my dependant up on success in my ILR application.

Then, she has to wait at least two more years instead of one month.

I hope some one who attended a session at a PEO office would answer this one.

She may not be allowed entry at the PEO as she is not an applicant. There is no need to take the child to the PEO as it is not mandatory for dependents to attend the appointment at the PEO with the main applicant.
