Hi There,

Wife has recently completed 6 years discretionary leave outside of the immigration rules.

Due to the amount of processing time the UKBA took on the last occasion, her residence permit and passport weren't returned back to us to early Feb 2009, meaning the new permit run's till Feb 2011.

We've been advised that she need's to fill in SET (O) Form, but that this form can't be submitted 28 Days prior to when the existing leave in place is set to expire, which would mean roughly second week in Jan 2011.

Does anyone have any idea if we can apply now or have to wait for the 28 Day rule to apply ?

End of qualifying period is not necessarily expiry date of current leave / visa!

Also, under section three of the SET (O) form which category should she tick ? would it be

Long residence in the UK

or

Other purposes or
reasons not covered by other application forms
