Help with Spouse ILR application

Hi Everyone,

I am in a bit of a dilemma and would appreciate your help.

My wife came to the uk on 25 December 2006 on 2 years spouse visa, i had applied for 2 years extension on 20 December 2008 due to her not passing the life in the uk test and realised it was too late to do the esol course.

Got the extension from 16 march 2009 till 15 march 2011 but now I would like apply for her ILR. My question is

1. Can I apply now or do I have to wait until march 2011
2. If I can, do I need to use the documents already previously provided for the extension covering the 2 year period.

When I applied for the extension, I was not able to provide 8 month period of letters in both our names, so a letter was written by a relative confirming the residential status. My question is

1. Do I need to amend the original letter because we have moved recently or change the letter date.

Ya ofcourse u can any time after two years but ur spouce should pass life in uk test or esol and u can send all documents that u have used before but with the new ones till the date u sending application or may they ask u some more later thanks

Thanks for your reply.

My wife has passed the ESOL course.

About the application, if i was to apply by 5th November, can i send two years documents going back to Nov 2008 or will i need to send the whole length since her entrance in the UK until the application.

Provide documentary evidence of cohabitation covering the 2 years preceding the settlement application.

Ya u can send old one u used before but u should send some new one till this date if u send the old documents they will ask u for new ones before making decesion anyway
