Hi, I'll be applying soon for ILR under HSMP JR... i have some questions...

1. If you live in the north of England, should you apply to Liverpool or Sheffield PEO in person?

2. I fall under Judicial review due to my HSMP application date being before April 2006, even though approval letter was received after April 2006. Should this fact be given in a cover letter? Would all PEOs be able to bring up records of date of lodgement of HSMP application?

3. Would it be okay to apply by post instead? Or is it better to verbally convey the fact that the lodgement of my application was before April 2006?

4. What is the difference between paid and unpaid absence? How do you prove a paid absence?

5. I have about 130 days total absence, of which about 15 days was unpaid. Is this okay?

6. I don't have P60s for all years, so do I have to show salary slips for all 4 years? or only the last year or so?

2. No harm in stating the important fact in your cover letter. UKBA can access all information they hold about you.
3. Your choice whether you wish to apply in person or by post.
4. Paid - you are entitled to be paid (salary) for the days one is on leave. Unpaid - no salary paid for the days one is on leave. A letter from employer should help prove paid / unpaid leave (absence).
5. Depends on the total number of absences in the 4 year period. If 130 is the number of total absences, then should be no reason to worry.
6. No definite answer to such a question - as per posts on the forum, some applicants have been asked for P60s and some have not. It is better to be prepared for the worst and hope for the best!

Do your dependents have to appear in person too?

When booking an appointment for in-person application one must book a family appointment to include dependent(s) eligible for settlement at the same time as the main migrant.

Whether you wish to take dependant(s) along to the PEO on the day or attend on your own is a personal choice.

As all other questions have been answered:

6- Asking for P60s is a bit hit and miss but i dont recall anyone posting on this board that they were asked for last 4 years payslips. Personally dont worry about the payslips going back 4 years. Have payslips for last 6 monhts. Mostly they ask for last 3 months only but could ask for 6 months.
