CAN THIS ISSUE ABOUT DEPENDANT BE CHALLENGED IN THE COURT

Why must a spouse who is legally resident in UK be asked to leave UK in other to switch to dependant.
can we reason that this part of immigration law can be challenged.

where we have couples who have been living together for more than 2 years.does it make sense for one of them to travel back home to apply for EC as dependant when s/he is legally residing in UK

Home office said in their website that dependant is someone who dependant on you financially such as husband,wife and children under 18


i am not talking of those who marry today and want to change immigration status tommorrow.

I have read where a lot went back home to apply and their applications was delayed for several months and they are separated from their work spouse and children.
unless you are a director of a company,it is very difficult to leave job for 4 weeks because one want to switch to dependant

I understand that law is powerful but at the same time it can be challenged and be amended.
We should have lawyers that can take this up on behalf of many of us.
I want everybody to please contribute.

if u have all required documents then it doenst take 4 weeks to sort this out. and remember that its not compulsory to switch to dependent unless either original visa is expiring or one wants to apply for ILR as dependent.

good luck trying to challenge this in court.............
