Hi,

I came to UK on 31st Jan 2006 on work permit. My huband joined me here as a work permit dependent september 2006.

June 2007 I have got my HSMP and my husband was on HSMP dependent. In March 2009 me and my husband got Independent TIER-1.

Now we have cleared the Life in the UK test. Applying for ILR.

Could anyone clear me can we both apply together for this. The question here is since he is on his own Tier-1 and we are living together since 2006 can we both apply together.

As a Tier 1 holder, your husband will need to satisfy the settlement requirements (earliest around March 2014) for Tier 1`holders.

However, if he first obtains entry clearance as your dependant, then he may apply for ILR together with you.

As we both are independent Tier-1 holders is it possible for my husband to obtain entry clearnce here in UK or does he needs to go to India for this?

An entry clearance is only obtainable from outside the UK.

I too agree that for EC we need to go to our home country.

My husband is looking to change his status from Tier-1 General to my Depedant ie. Tier-1 General Dependant. Is this status change called EC? Is it possible change his status as incountry application?

How difficult to change the status from Tier-1 General Migrant to Tier-1 Dependant? Do we need to satifies the Entry Clearance Officer? Do they ask any reason for the switch over? What are the documents needs to be submit for this process?

As already mentioned by Vinny, to change status from Tier 1 (General) migrant to that of dependant of Tier 1 (General) migrant, an application (for entry clearance) must be made from outside the UK.

If the applicant meets the requirements, and submits the necessary documentary evidence(s) to support the application, there is no reason why a visa will not be granted.

1. PEO appointment is not an "interview".
2. Whether or not you wish to take any dependant(s) to the PEO is your choice.
